The essay examines Scholem's letter-confession on the Hebrew language addressed to Rosenzweig from two perspectives hitherto ignored in the ongoing interpretative consideration of this document: Scholem's repression of the literary space and his consequent exclusion of madness. The essay follows several threads in Derrida's own ‘internal’ reading of the letter, and leans on other Derridean writings such as The Monolingualism of the Other, Schibboleth: For Paul Celan and ‘Cogito and the History of Madness’ in order to suggest two distinct encounters (...) between Derrida and Scholem: In the first encounter, Scholem reads Derrida and proves to be deconstructing his own notions of secular and profane Hebrew, while fighting in vain for his sanity by clinging to liturgical practices against the grain of an ongoing ‘actualization’, politicization or else fictionalization of the sacred language. In the second encounter, it is Derrida who reads Scholem. By transforming the particular conditions of possibility of Hebrew into general conditions of possibility of every language contaminated by a theological-political tension, Derrida contributes some important insights for contemporary Hebrew speakers. The book Chronicle of Separation is an attempt to write on Derrida, to Derrida and from Derrida on the basis of a pathetic experience, which, in various ways, describes and enacts the pathetic experience of deconstruction itself. The book tackles the weight of emotions that is at the heart of deconstructive reading, treating deconstruction's weak, fragile and parasitic mode of thinking as a deconstruction of emotion, on emotion and as emotion. Chronicle of Separation examines these themes beginning with a descriptive (...) and an analytic reading of Derrida's Memoirs: For Paul de Man and The Post Card, as embodiments of deconstruction's melancholic friendship which inscribes its disillusioned love in what it calls the 'postal condition'. The book then moves on to a feminization of Derrida, experimenting in different modes of writing. It firstly discusses Fred Zinneman's film Julia about a mournful friendship between women. Then it performs a deconstructive meditation on the anorexic person suggesting that anorexia constitutes a paradoxical embodiment of deconstruction. The concluding chapter presents a complete incorporation of Derrida into a fictional text that re-writes the biblical Book of Ruth. (shrink)

This article focuses on the location of the duty of loyalty—a unique legal norm in Common Law jurisdictions—both actual and desirable, on the continuum between rules and standards. A rule is a relatively ‘closed’ technical norm, at a high level of specificity; it requires little judicial discretion. A standard is an ‘open’ norm, with a greater degree of flexibility, that requires the exercise of discretion. The insights from this jurisprudential perspective are used to reveal the preferred way for further developing (...) the duty of loyalty. The article explains that ‘loyalty,’ intuitively classified as a ‘pure’ standard, has been reconstructed over time as more specific rules. Moreover, it suggests that, ideally, this movement should continue; namely, when applying loyalty to a specific case, courts should include informative content that would promote predictability. It then illustrates that, unfortunately, this road is not always taken by the courts. A decision to retain loyalty as an ad hoc standard, or an inverse attempt to delineate the boundaries of this norm, has implications on the certainty, consistency, and ethical content of the law. Considering that this duty spreads across different legal fields, personal and commercial, the significance of this discussion becomes all the more evident. (shrink)

We generalize the notion of analytic/Borel equivalence relations, orbit equivalence relations, and Borel reductions between them to their continuous and quantitative counterparts: analytic/Borel pseudometrics, orbit pseudometrics, and Borel reductions between them. We motivate these concepts on examples and we set some basic general theory. We illustrate the new notion of reduction by showing that the Gromov–Hausdorff distance maintains the same complexity if it is defined on the class of all Polish metric spaces, spaces bounded from below, from above, and from (...) both below and above. Then we show that [Formula: see text] is not reducible to equivalences induced by orbit pseudometrics, generalizing the seminal result of Kechris and Louveau. We answer in negative a question of Ben Yaacov, Doucha, Nies, and Tsankov on whether balls in the Gromov–Hausdorff and Kadets distances are Borel. In appendix, we provide new methods using games showing that the distance-zero classes in certain pseudometrics are Borel, extending the results of Ben Yaacov, Doucha, Nies, and Tsankov. According to the orthodox view, the goodness of a life depends exclusively on the things that actually happened within it, such as its pleasures and pains, the satisfaction of its subject’s preferences, or the presence of various objective goods and bads. In this paper, I argue that the goodness of a life also depends on what could have happened, but didn’t. I then propose that this view helps us resolve ethical puzzles concerning the standards for a life worth living for (...) animals and the significance of a life’s shape. (shrink)

The idea that the state ought to be neutral towards different conceptions of the good life has been an influential principle in liberal theory since the 1970s. It has, however, been subject to criticism by communitarians, multiculturalists and liberal perfectionists. Recently, Peter Balint has attempted to defend state neutrality against its liberal critics as the adequate interpretation of the liberal project by redefining it as a range concept. By arguing that neutrality always occurs within a specific range of permissible conceptions (...) of the good life, Balint provides a convincing rebuttal of neutrality’s critics. In this paper I argue that while neutrality as a range concept provides an adequate account of state neutrality, it also makes it vulnerable to a new line of critique. Since the range of neutrality cannot be deduced from the principle of neutrality itself, neutrality is subject to political developments beyond its own control. I will start by clarifying the notion of neutrality as a range concept. Secondly, I will demonstrate that Balint’s notion of the range concept finds ample support in the wider literature on neutrality. Thirdly, I will argue that, as a range concept, neutrality ultimately depends on politically constituted value judgments. (shrink)

Ectogenesis (artificial wombs) might soon become a reality. This paper will analyse how the development of such technologies will affect Judith Jarvis Thomson’s defence of abortion, and what the potential consequences of this will be for society. Thomson attempts to justify abortion by appealing to the mother’s right to bodily autonomy. We will argue that once these technologies have been developed, the right to abortion can no longer be justified by such appeals. As a result, when justifying abortion, Thomson-style arguments (...) will no longer work, and a very different strategy will have to be adopted by those wishing to justify its permissibility. Anticipating a consequent weaker position of the pro-choice view, we briefly consider some of the practical implications of ectogenesis for society: effects on parental dynamics, governmental expenditure, research, and gender equality. _Foucault’s Law_ is the first book in almost fifteen years to address the question of Foucault’s position on law. Many readings of Foucault’s conception of law start from the proposition that he failed to consider the role of law in modernity, or indeed that he deliberately marginalized it. In canvassing a wealth of primary and secondary sources, Ben Golder and Peter Fitzpatrick rebut this argument. They argue that rather than marginalize law, Foucault develops a much more radical, nuanced and coherent (...) theory of law than his critics have acknowledged. For Golder and Fitzpatrick, Foucault’s law is not the contained creature of conventional accounts, but is uncontainable and illimitable. In their radical re-reading of Foucault, they show how Foucault outlines a concept of law which is not tied to any given form or subordinated to a particular source of power, but is critically oriented towards alterity, new possibilities and different ways of being. _Foucault’s Law_ is an important and original contribution to the ongoing debate on Foucault and law, engaging not only with Foucault’s diverse writings on law and legal theory, but also with the extensive interpretive literature on the topic. It will thus be of interest to students and scholars working in the fields of law and social theory, legal theory and law and philosophy, as well as to students of Foucault’s work generally. This paper presents a literature review on the ethics of self-tracking technologies which are utilized by users to monitor parameters related to their activity and bodily parameters. By examining a total of 65 works extracted through a systematic database search and backwards snowballing, the authors of this review discuss three categories of opportunities and ten categories of concerns currently associated with self-tracking. The former include empowerment and well-being, contribution to health goals, and solidarity. The latter are social harms, privacy and (...) surveillance, ownership control and commodification of data, autonomy, data-facilitated harm, datafication and interpretability of data, negative impact on relation to self and others, shortcomings of design, negative impact on health perception, and regulation and enforcement of rules. The review concludes with a critical analysis of the existing literature and an overview of a future research agenda that could complement the current work on ethics of self-tracking. (shrink)

In this paper, I offer an account of the dependence relation between perception of change and the subjective flow of time that is consistent with some extant empirical evidence from priming by unconscious change. This view is inspired by the one offered by William James, but it is articulated in the framework of contemporary functionalist accounts of mental qualities and higher-order theories of consciousness. An additional advantage of this account of the relationship between perception of change and subjective time is (...) that is makes sense of instances where we are not consciously aware of changes but still experience the flow of time. Recent progress in geroscience holds the promise of significantly slowing down or even reversing ageing and age-related diseases, and thus increasing our healthspans. In this paper, I offer a novel argument in favour of developing such technology and making it unconditionally available to everyone. In particular, I argue that justice requires that each person be provided with sufficient opportunities to have a ‘complete life’, that many people currently lack such opportunities, and that we would substantially improve the status quo by (...) giving them access to anti-ageing technology. This new volume explores terrorism and strategic terror, examining how the public responds to terrorist attacks, and what authorities can do in such situations. The book uses a unique interdisciplinary approach, which combines the behavioural sciences and international relations, in order to further the understanding of the 'terror' generated by strategic terror. The work examines five contemporary case studies of the psychological and behavioural effects of strategic terror, from either terrorist attacks or aerial bombardment. It also looks at how risk-communication (...) and public-health strategies can amplify or reduce psychological and behavioural responses, and considers whether behavioural effects translate into political effects, and what governments can do to relieve this. Ultimately, the study argues that the public is not prone to panic, but can change their behaviours to reduce their perceived risk of being exposed to a terrorist attack. We can make a difference in shaping the future by ensuring that computers "serve human needs." By making explicit the enduring values that we hold dear we can guide computer system designers and developers for the next decade, century, and thereafter. After setting our high-level goals we can pursue the components and seek the process for fulfilling them. High-level goals might include peace, excellent health care, adequate nutrition, accessible education, communication, freedom of expression, support for creative exploration, safety, and socially (...) constructive entertainment. Computer technology can help attain these high-level goals if we clearly state measurable objectives, obtain participation of professionals, and design effective human-computer interfaces. Design considerations include adequate attention to individual differences among users, support of social and organizational structures, design for reliability and safety, provision of access by the elderly, handicapped, or illiterate, and appropriate user controlled adaptation. With suitable theories and empirical research we can achieve ease of learning, rapid performance, low error rates, and good retention over time, while preserving high subjective satisfaction. To raise the consciousness of designers and achieve these goals, we must generate an international debate, stimulate discussions within organizations, and interact with other intellectual communities. This paper calls for a focus on the "you" and "I" in developing improved user interface research and systems, offers a Declaration of Responsibility, and proposes a Social Impact Statement for major computing projects. Continual pressure on managers, their efficiency, and the need to search for novel solutions to problems can lead to psychologically demanding situations. In efforts to understand the main obstacles to work and to effectively manage work-related processes, and in the need to achieve personal development, new approaches that are based on existential philosophies emerge. The aim of this article is to highlight the ways in which existential approaches have been used or discussed in management and to show that existential themes (...) and their applications in management can also be found in the Eastern tradition of thought. The paper presents six case vignettes from management practice that use Western and Eastern existential insights and offer recommendations for self-development of managers. The paper concludes that although it is difficult or impossible to create a unified framework of existential philosophy of management because of the diversity of existential approaches and because of the problematic nature of comparing Eastern and Western philosophies, it is possible to work towards gathering applicable insights and values. The chapter is devoted to the probability and acceptability of indicative conditionals. Focusing on three influential theses, the Equation, Adams’ thesis, and the qualitative version of Adams’ thesis, Sikorski argues that none of them is well supported by the available empirical evidence. In the most controversial case of the Equation, the results of many studies which support it are, at least to some degree, undermined by some recent experimental findings. Sikorski discusses the Ramsey Test, and Lewis’s triviality proof, with special (...) attention dedicated to the popular ways of blocking it. Sikorski concludes that the role of the three theses in future studies of conditionals should be re-thought, and he presents alternative proposals. (shrink)

The aim of this paper is to present the ontic approach to the normativity of cognitive functions and mechanisms, which is directly related to the understanding of biological normativity in terms of normative mechanisms. This approach assumes the hypothesis that cognitive processes contain a certain normative component independent of external attributions and researchers’ beliefs. This component consists of specific cognitive mechanisms, which I call normative. I argue that a mechanism is normative when it constitutes given actions or behaviors of a (...) system. More precisely, it means that, on the one hand, it is their constitutive cause, and on the other hand, it determines a certain field of possibilities from which the system, guided by its own goals, preferences, environmental constraints, etc., chooses the appropriate action or behavior according to a given situation. The background for the analyses presented here is the predictive processing framework, in which it can be shown that at least some of the predictive mechanisms are in fact normative mechanisms. I refer here to the existence of a motivational relation which determines the normative dependence of the agent’s actions due to specific predictions and environmental constraints. (shrink)

The discussion about a difference between brain and soul or mind is now at the center of the anthropological debate. It seems that the pioneers in this current polemic have a reductionistic view of human nature, inherited from the Cartesian solution to mind-body problem and the modern materialistic explanation of reality. This view – dualistic or monistic – about the opposition between material and immaterial structure of the person, claims that as a consequence of scientific progress, the human brain in (...) the future could be completely explained in naturalistic terms. On the other hand, according to the new results of scientific research, this situation reveals the possibility to develop a new, more adequate paradigm of man as an incarnated person. This change was called by many researchers “the passage from the mind-body problem to the person-body problem”. It seems that the Aristotelian-Thomistic approach is the most suitable to describe this “paradigm shift”. Aristotelian-Thomistic philosophy undoubtedly encourages lively dialogue between philosophy and contemporary sciences through its dual ontology. Thus, it can give suitable answers for questions about the nature of human reason ; unity of composition of the human brain and the role of causality in natural processes. (shrink)

The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper discusses several topics that relate more naturally to groups of papers than a single paper published in the journal: ontologies, reasoning about evidence, the various contributions of Douglas Walton, and the practical application of the techniques of AI and Law.

Programming computers to engage in moral reasoning is not a new idea (Anderson and Anderson 2011a). Work on the subject has yielded concrete examples of computable linguistic structures for a moral grammar (Mikhail 2007), the ethical governor architecture for autonomous weapon systems (Arkin 2009), rule-based systems that implement deontological principles (Anderson and Anderson 2011b), systems that implement utilitarian principles, and a hybrid approach to programming ethical machines (Wallach and Allen 2008). This chapter considers two philosophically informed strategies for engineering software (...) that can engage in moral reasoning: algorithms based on philosophical moral theories and analogical reasoning from standard cases.1 Based on the challenges presented to the algorithmic approach, I argue that a combination of these two strategies holds the most promise and show concrete examples of how such an architecture could be built using contemporary engineering techniques. The case of Alta Fixsler, where a judge ruled that withdrawing life sustaining care was in her best interest rather than transferring her to Israel, as her parents wanted, is the latest in a series of controversial paediatric best interest decisions. Using this case, as well as some other recent cases, I argue that the UK exhibits a high degree of medico-legal paternalism in best interest decisions, even though paternalism seems to be ubiquitously negatively perceived in medical ethics. Firstly, I (...) explain what I mean by medico-legal paternalism and defend my claim that this phenomenon is present in the UK. I then argue that at least philosophically (rather than legally) such a situation is impossible to justify in a secular state and that how we treat paediatric best interest decisions is very different from other areas of medical law. It has been noticed by several authors that the colloquial understanding of anonymity as mere unknown-ness is insufficient. This common-sense notion of anonymity does not recognize the role of the goal for which the anonymity is sought. Starting with the distinction between the intentional and unintentional anonymity (which are usually taken to be the same) and the general concept of the non-coordinatability of traits, we offer a logical analysis of anonymity and identification (understood as de-anonymization). In our enquiry, we focus (...) on the intentional aspect of anonymity and develop a metaphor of “anonymity game” between “perpetrator” and “detective”. Beginning from common-sense intuitions, we provide a formalized, critical notion of anonymity. (shrink)

In this paper, I attempt to address some of the themes of Ludwig Wittgenstein’s Tractatus logico-philosophicus with the aim of their deconstructionist interpretation. My analysis is based on David Gunkel’s book Deconstruction (MIT Press 2021). Based on some of its findings, I show how the Tractatus allows deconstruction and its practice to be thought. I show that the graphic structure of signs is crucial for the young Wittgenstein’s analysis and that it justifies the metaphysical findings in favor of which he (...) argues. ------------------------- Received:11/09/2022.
